Drug Crimes Defense Attorney of South Florida

There are several methods which law enforcement utilizes in order to arrest a person for drug dealing or distribution:

  • A controlled buy:  This occurs when a person sells illegal drugs to an undercover police officer or a police informant.
  • Intent to distribute:  To show that a person intended to sell drugs or narcotics, the police must be able to point to specific circumstances which indicate drug dealing such as the presence of a large amount of cash or many small individually wrapped packages.
  • Trafficking:  In Florida, if the amount of drugs that is in a person's possession exceeds a certain weight, then you can automatically be charged with drug trafficking without any other showing of intent.

Delivery of Cocaine: 

  •  Delivery or sale of even a small quantity of cocaine is a second degree felony in Florida where a person will face a possible prison sentence of 15 years in state prison id convicted.  If a person is convicted of delivery of cocaine in excess of 10 grams, then under Florida law they can be charged with a 1st degree felony and face up to 30 years in Florida state prison.   (See Fla. Stat. 893.13(1)
  • Delivery of cocaine within 1000 feet of a child care facility, college or place of worship is a 1st degree felony in Florida with a mandatory minimum term of imprisonment of at least 3 years. 
  • Trafficking in cocaine occurs in Florida when a person possesses over 28 grams of cocaine regardless of what their intent is.  Trafficking in cocaine is a 1st degree felony in Florida and a conviction will result in a 3 year mandatory term of imprisonment and a $50,000 fine.
