Florida's Ignition Interlock Program

If an ignition interlock device is installed in a vehicle, then the vehicle will not start if the operator's blood alcohol content (BAC) is in excess of .05 percent.  While all drivers who are convicted of DUI in Florida face the possibility of having an ignition interlock installed in their vehicles, there are some circumstances where it is mandatory.

  1. For a first time DUI, an ignition interlock can be ordered at the discretion of the court.  Having a skilled DUI attorney representing you will minimize this possibility in your case.
  2. A second DUI conviction within 5 years will result in the mandatory placement of an ignition interlock device in the driver's vehicle at the driver's expense for a period of at least 1 year.
  3. If a person is convicted of 3 DUI offenses within a 10 year period, then they will be required to have an ignition interlock device installed in their vehicle for a term of at least 2 years.
  4. You will be required to have an ignition interlock device installed if you are convicted of an aggravated or enhanced DUI.
