Drug Trafficking in Florida

What is trafficking?

• Trafficking is defined by Florida law as to "knowingly sells, purchases, manufactures, delivers, or brings into the state, or who is knowingly in actual or constructive possession".

Florida has very strict mandatory sentencing guidelines for those who are convicted of drug trafficking:  (See Fla. Stat. 893.135)

Trafficking in Cannabis

• If a person is convicted of trafficking in marijuana who was arrested with between 25 and 300  pounds of marijuana will face a minimum term of imprisonment of 3 years and a $25,000 fine. 
• If a person is arrested with over 2000 pounds of marijuana but less than 10,000 pounds, then they will face a mandatory sentence of 7 years in prison and a $50,000 fine if they are convicted of trafficking in marijuana.
• 10,000 pounds or more will lead to a mandatory sentence of 15 years in prison and a $200,000 fine. 

Trafficking in Cocaine

• Trafficking in cocaine is a felony of the first degree in Florida.  Simply possessing 28 grams or more of cocaine constitutes "cocaine trafficking.
• If a person is convicted of trafficking in more than 28 grams but less than 200 of cocaine, then they will be facing a mandatory minimum sentence of 3 years in state prison and a $50,000 fine. 
• 200 grams or more but less than 200 grams and a person will face a mandatory prison sentence of 7 years and a $100,000 fine. 
• If a person is convicted of trafficking in cocaine over 400 grams, then they will face a mandatory minimum 15 years in state prison and a $250,000 fine. 

Trafficking in Heroine and Trafficking in Prescription Pain Killers

• Trafficking in heroine or painkillers which weigh more than 4 grams but less than 30 kilograms commits a felony of the first degree.
• Being convicted of trafficking in heroine or painkillers which weigh 4 grams or more, but less than 14 grams will subject a person to a mandatory minimum sentence of 3 years in prison and a $50,000 fine. 
• 14 grams or more, but less than 28 grams and a person will face a mandatory minimum of 15 years in state prison and a $100,000 fine. 
• 28 grams or more, but less than 30 grams and a person faces a mandatory minimum sentence of 25 years in prison and a $500,000 fine. 

Trafficking in Methamphetamines

• Trafficking in Methamphetamine is a felony of the first degree.
• If a person is convicted of trafficking in 14 grams or more but less than 28 grams of methamphetamine, then they will face a mandatory minimum prison sentence of 3 years in prison and a $25,000 fine.
• 28 grams or more but less than 200 grams will subject a defendant to a mandatory minimum sentence of 7 years in prison and a $100,000 fine. 
• Trafficking in methamphetamine which is over 200 grams will lead to a mandatory minimum 15 years in state prison and a $250,000 fine. 

Trafficking in MDMA

• Trafficking in Ecstasy or trafficking in Molly is a first degree felony in Florida. 
• 10 grams or more but less than 200 grams leads to a mandatory minimum 3 years in state prison and a $50,000 fine. 
• 200 grams or more but less than 400 grams will lead to a mandatory minimum sentence of 7 years in prison and a $100,000 fine. 
• 400 grams or more will lead to a mandatory minimum prison sentence of 15 years in prison and $250,000 fine. 

Trafficking in LSD

• Trafficking in LSD is a felony of the first degree.
• Trafficking in LSD which weighs more than 1 gram but less than 5 grams will subject a defendant to a mandatory minimum prison sentence of 3 years in prison and a $50,000 fine. 
• 5 grams or more but less than 7 grams of LSD subjects a person to a mandatory minimum of 7 years in prison and a $100,000 fine.
• 7 grams or more and a person faces a mandatory minimum 7 years in state prison and a $250,000 fine.
